Standing in opposition are, on the one hand, the uncompromisingly significant economic interests on the part of the content industry, and those of providers, telecommunications and technology industries on the other. This heated discussion is reflected, in particular, in the zigzag course of the legal application of liability with respect to providers in German and European law. This can be provider liability set forth in the DMCA in its enumerative form roughly resembles European law as seen in the E-Commerce Directive.(9) As far as the secondary copyright liability on the part of operators of P2P file-sharing systems is concerned, US case law in the decisions of numerous instances firstly solved the question of secondary liability of operators of centralised file-sharing systems. Meanwhile, after an initially restrained legal treatment of decentralised systems in lower courts, the US Supreme Court has also found an approach to deal with such decentralised systems in the world-renowned Grokster decision, which in this specific case led to an affirmation of secondary liability.(10) The chosen solution via inducement liability consciously leaves open some of the numerous questions raised by the rapid development of P2P file-sharing systems.(11) As far as this is concerned, a significant interest in comparing the approaches of the US \"interim solution\" with the treatment of P2P file-sharing systems in Germany and Europe seems to exist. This article puts forth an attempt to introduce the German and European perspective into the global discussion.(12) The questions raised within the scope of this article, which essentially relate to the liability of the operators of P2P file-sharing systems, quickly return to the fundamentals of liability law, in particular to the relationship of secondary responsibility for causes of risk and the primary liability of the actual rights infringer. To begin with, this article will clarify the technical facts (H). Subsequently, principal developments in European and, in particular, in German law will be discussed (III, IV).
