It still has to be clarified how gender aspects can be integrated without sustaining gender stereotypes. The developmental psychologist Carol Gilligan was among the first to question ethics from a gendered point of view. The notion of care introduced by her challenged conventional developmental psychology as well as moral philosophy. Gilligan was criticised, however, because her concept of ‘two different voices’ may reinforce gender stereotypes. Moreover, although Gilligan stressed relatedness, this is not reflected in her own empirical approach, which still focuses on individual moral reflection. Concepts from social psychology can help overcome both problems. Social categories like gender shape moral identity and moral decisions. If morality is understood as being lived through actions of persons in social relationships, gender becomes a helpful category of moral analysis. Though such a rationalization is generally seen as an objective and 'value free' process, moral values often play a hidden role, not only in the production of 'evidence', but also in the way this evidence is used in policy making. For example, the definition of effectiveness of medical treatment or health care service is heavily dependent on dominant individual or social views about the goals of the particular treatment or service. There is also a concern that a reliance on EBM in health policy will occur at the expense of widely shared social values like equity and solidarity. Moreover, there is a concern that when economic considerations and rational procedures become more influential, various 'outside' groups third parties like insurance companies and policy makers will get a stronger influence on medical practice which may lead to a change in the patient-provider relationship. Damit deutet sich zugleich ein Paradigmenwechsel in der Leistungsallokation an - weg von der gleichmäßigen Versorgung in der Fläche, hin zur Konzentration auf spezialisierte Zentren - dessen ethische Implikationen noch unklar sind. Einerseits erhofft man sich eine Reduzierung der Kosten im Bereich der stationären Krankenversorgung. Andererseits ist fraglich, ob diese Kostenreduktion nicht zu einer schlechteren Versorgung von multimorbiden und chronisch kranken Patienten führt. Das neue System dürfte zwar dem aktiven, autonom entscheidenden Patienten entgegenkommen, der ein Mehr an Informationen aus den geplanten Qualitätsberichten nutzt, um für sich ein Maximum an hochwertigen medizinischen Dienstleistungen zu realisieren. Auf der anderen Seite könnte das neue System aber Patientengruppen benachteiligen, die zur aktiven Nutzung solcher Informationen nicht oder weniger gut in der Lage sind. Sometimes it is necessary to involve psychosomatics or ethics consultation to evaluate a prospective donor to make certain that the requirements for a voluntary and autonomous decision are met. The paper focuses on the conceptual questions underlying this evaluation process. In order to illustrate how different views of autonomy influence the decision if a donor's offer is ethically acceptable, three cases are presented - from Germany, the United States, and India. Each case features a person with questionable decision-making capacity who offered to donate a kidney for a sibling with severe renal insufficiency. Although the normative framework is similar in the three countries, different or sometimes even contrary arguments for and against accepting the offer were brought forward. The subsequent analysis offers two explanations for the differences in argumentation and outcome in spite of the shared reference to autonomy as the guiding principle: (1) Decisions on the acceptability of a living donor cannot simply be deducted from the principle of autonomy but need to integrate contextual information; (2) understandings of the way autonomy should be contextualized have an important influence on the evaluation of individual cases.
